TERMS & CONDITIONS
These terms and conditions set the contractual relationship between the company GoGusto, s.r.o. and its customers. An order sent to gogusto.lu implies acceptance of these terms and conditions. “We”, “GoGusto” and “gogusto.lu” are hereby used interchangeably to refer to GoGusto, s.r.o, Jokaiho 30, 821 06 Bratislava, Slovakia. The terms “You” and “the customer” are used to refer to the end-consumer or client/customer of a GoGusto product.
All orders made by a customer on the website gogusto.lu imply the acceptance of these terms and conditions. No final order can be processed if the customer has not previously accepted the terms and conditions by checking the provided box. Before finalizing the order, the customer can at any time modify or cancel it.
These terms and conditions prevail over all other conditions contained in any other document, unless differently agreed by a written statement.
All products are presented with a name, description and quantity. Photos of the products are only indicative. The photos, pictures and illustrations of the products do not fall within the scope of the contract. The responsibility of gogusto.lu will not be engaged.
The products presented on the site are generally available and are produced after customer’s order. It is however possible that a product is out of stock and can not be produced. This missing product will then be deducted from the global order and will not be charged. Gogusto.lu will do what is possible to ensure that the majority of products are always available.
Prices shown on the site gogusto.lu are final. The delivery costs are being stated at checkout. We charge flat fee for deliveries accross all EU countries.
Except for display errors, we guarantee the prices shown on our website. Gogusto.lu can’t be held responsible for any display error.
After placing an order on our website the customer will receive an e-mail from us acknowledging that we have received the order. Please note that this does not mean that the order has been accepted. We will additionally notify you to confirm the acceptance of your order or delivery via phone or email once payment has been credited to our Bank or Paypal account.
Payments are made with PayPal or via Bank Transfer.
Paypal. We provide the customer a secured and certified payment system that protects against the risk of fraud and that guarantees the confidentiality of credit card numbers by cryptology procedures. PayPal is responsible for the security of the cardholder data. GoGusto, s.r.o. does not store any cardholder data neither in paper or electronic form. PayPal accepts VISA, Mastercard, Discover and American Express.
The order will be accepted by the system after verification of the credit card. It is therefore up to the customer to check the type of the credit card and its validity.
Bank Transfer. If you choose this option, information about our bank details will be sent in email together with confirmation that we have received your order.
6.1. Gogusto.lu uses the services of Couriers or Post office for deliveries across all EU countries. During checkout, the customer may choose freely the address he would like the products to be delivered to, as long as this is a valid physical address (no post-box addresses possible). Should the customer like to modify the delivery address, please do so via email to info(at)gogusto.lu, and notify us lastest the day before the delivery date.
6.2. Deliveries occur usually 7 to 14 days after your payment. If the delivery day coincides with a public holiday, gogusto.lu reserves the right to change the delivery date to a different day.
6.3. Gogusto.lu may not be held responsible for delays in delivery or non-delivery. In the case of a cancellation due to non-delivery by GoGusto, GoGusto will then reimburse the full amount of the order.
6.4. Product quality is guaranteed by our services. As soon as delivery is done, the quality of the products is no longer the responsibility of gogusto.lu.
6.5. You are responsible for making suitable arrangements to receive your delivery and giving us appropriate instructions. You are responsible for ensuring that any delivery point given for a work address is acceptable to your employer for personal deliveries. If it is possible that you may be unable to accept delivery in person you must provide us with a back up contact person who will be available.
6.6. In the event that your delivery is stolen from your doorstep or other place specified to us or damaged while there we do not accept liability and will offer compensation only at our discretion.
6.7. If we are unable to deliver to the address that you have given to us for any reason, we or Courier will attempt to contact you to make other arrangements. We or Courier will normally contact you using the telephone number that you have indicated during checkout and it is your responsibility to ensure that you are available on this number. If we are unable to deliver in such circumstances, we reserve the right to charge you for that order in any event.
6.8. If we are unable to deliver to you, or have to deliver late, for reasons beyond our control, for example adverse weather conditions, strike actions, vehicle breakdown, traffic congestion or supplier failure, we cannot accept liability for any inconvenience or loss this causes.
6.9. We will not charge you for products that we have not delivered in accordance with these terms and conditions. Otherwise our liability in respect of incorrect delivery is limited to the price of your order.
6.10. Changes to your delivery address must be notified to us within our order deadlines. We are not obliged to accommodate late changes to your delivery address. In the case of an error in the address of the customer during checkout and payment process gogusto.lu can’t be held responsible for the inability to which it might be to deliver the ordered goods.
7.1. For all cancellations we do charge 50% of the purchase price. It is fair share of the costs for work and material spent on the customization of your product. This product can not be sold to other customer.
7.2. If you cancel before instructions for production were sent to production we will be happy to offer you a full refund or a credit to use at another time, whichever is your preference. This is possible usually within 24 hours after your payment.
7.3. Any cancellation must be specifically accepted by us over the phone (and confirmed in writing) or by email during our normal office hours.
8.1. We warrant to the customer that any product purchased from us through our site will, on delivery, conform with its description, be of satisfactory quality, and be reasonably fit for all the purposes for which products of that kind are commonly supplied.
9.1. For discrepancies in the quantity and damages only claims made the same day of the delivery will be considered.
9.2. Gogusto.lu is not liable for damages of any kind, bodily or material, which might arise from the wrong or inadequate use of its products.
9.3. Gogusto.lu is not liable for deterioration in the quality of its products after being delivered to the customer.
9.4. Once past a delay of 24 hours after delivery, the customer will no longer send any claims, with regard to compliance of the order or the status of the delivered products. All deliveries will be considered in accordance with the order.
10. Returns and Warranty Claims
10.1. All returns and Warranty Claims to be sent to: GoGusto, s.r.o., Jokaiho 30, 821 06 Bratislava, Slovakia via registered Courier.
10.2. Customer is obliged to send tracking Number to email address info(at)gogusto.lu. GoGusto is not responsible for the loss during delivery.
10.3. Transportation costs are covered by Customer.
11. Intellectual property rights
11.1. GoGusto, s.r.o. is the owner or the licensee of all intellectual property rights in the website gogusto.lu, whether registered or unregistered, and in the material published on it. These works are protected by copyright laws and all such rights are reserved.
11.2. The customer may print off one copy, and may download extracts, of any pages from our site for the customer personal reference. The customer must not use any part of our copyright materials for commercial purposes without first obtaining a license to do so from us and our licensors.
11.3. If the customer posts comments on the Products or Services to any website, blog or social media network (Commentary) the customer must ensure that such Commentary represents the customer fairly-held opinions. By subscribing to the Services the customer irrevocably authorize us to quote from the customer Commentary on our site and in any advertising or social media outlets, which we may create or contribute to.
12. Our rights to vary these terms and conditions
12.1. We have the right to revise and amend these terms and conditions from time to time to reflect changes in market conditions affecting our business, changes in technology, changes in prices and payment methods, changes in relevant laws and regulatory requirements and changes in our system's capabilities.
12.2. The customer will be subject to the policies and terms and conditions in force at the time that the customer order products from us, unless any change to those policies or these terms and conditions is required to be made by law or governmental authority (in which case it will apply to orders previously placed by the customer), or if we notify the customer of the change to those policies or these terms and conditions before we send the customer the Dispatch Confirmation (in which case we have the right to assume that the customer have accepted the change to the terms and conditions, unless the customer notify us to the contrary within seven working days of receipt by the customer of the Products).
